Duties[edit]

National Guard units can be mobilized at any time by presidential order to supplement regular armed forces, and upon declaration of a state of emergency by the governor of the state in which they serve. Unlike Army Reserve and Air Force Reserve members, National Guard members cannot be mobilized individually (except through voluntary transfers and Temporary Duty Assignments TDA), but only as part of their respective units. However, since September 11, 2001 there have been a significant number of individual activations under Title 10 USC to support military operations (2001–Present); the legality of this policy has been a major issue within the National Guard.

For much of the final decades of the twentieth century, National Guard personnel typically served "One weekend a month, two weeks a year", with a portion working for the Guard in a full-time capacity as either Active Guard and Reserve (AGR), Army Reserve Technicians or Air Reserve Technicians (ART). This changed dramatically during the 1990-91 Gulf War, and continued on to present day, with both the Federal Reserve Components and the National Guard increasingly utilized as an "operational" force for worldwide deployment.
The current forces formation plans of the US Army call for the typical Army National Guard unit (or Army National Guardsman) to serve one year of active duty for every three years of service. The US Air Force applies a similar utilization model for Air National Guard units (and Air National Guardsmen).
More specifically, previous Department of Defense policy was that no National Guardsman would be involuntarily activated for a total of more than 24 months (cumulative) in one six-year period. This policy has changed 1 August 2007, with the new policy stating that National Guard soldiers and airmen will be given 24 months between deployments of no more than 24 months; individual states have differing policies but remain subordinate to DoD policy).
As of July 2007, the Florida National Guard was composed of approximately 9,600 soldiers and airmen.[5]

The National Aeronautics and Space Administration (NASA/ˈnæsə/) is an independent agency of the United States Federal Government responsible for the civilian space program, as well as aeronautics and aerospace research.[note 1]

the USA Freedom Act (H.R. 2048Pub.L. 114–23) is a U.S. law enacted on June 2, 2015 that restored in modified form several provisions of the Patriot Act, which had expired the day before. The act imposes some new limits on the bulk collection of telecommunication metadata on U.S. citizens by American intelligence agencies, including the National Security Agency. It also restores authorization for roving wiretaps and tracking lone wolf terrorists.[3][4] The title of the act originally was a ten-letter backronym(USA FREEDOM) that stood for Uniting and Strengthening America by Fulfilling Rights and Ending Eavesdropping, Dragnet-collection and Online Monitoring Act.
The bill was originally introduced in both houses of the U.S. Congresson October 29, 2013, following publication of classified NSA memos describing bulk data collection programs leaked by Edward Snowdenthat June. When it was re-introduced in the 114th Congress (2015–2016), it was described by the bill sponsors as "a balanced approach"[5] while being questioned for extending the Freedom Act through the end of 2019.[6] Supporters of the bill said that the House Intelligence Committee and House leadership[7] would insist on reauthorizing all Patriot Act powers except bulk collection under Section 215 of the Patriot Act.[8] Critics assert that mass surveillance of the content of Americans' communication will continue under Section 702 of FISA which does not expire until 2017[9][10] and Executive Order 12333[9][11] due to the "unstoppable surveillance-industrial complex"[12] despite the fact that a bipartisan majority of the House had previously voted to close backdoor mass surveillance.[7]
Section 215 bulk collection authority expired June 1, 2015, but in the event that the Obama administration is successful in restarting it, USA Freedom enacts a ban on such collection activities which "shall take effect on the date that is 180 days after the date of the enactment of this Act."[13]
The USA Freedom Act mandates that the FISA court release "novel" interpretations of the law, which thereby sets precedent and thereby makes up the body of FISA court common law, as both legal authority for deciding subsequent cases, and for guidance parameters for allowing or restricting surveillance conduct.[14] The Act is not clear as to whether or not it mandates retroactive disclosure of decisions prior to passage of the Act in 2015.[14] In October 2016, the ACLU filed a Motion for the Release of FISA Court Records to release interpretations prior to the USA Freedom Act.[14]


The USA PATRIOT Act is an Act of Congress signed into law by United States President George W. Bush on October 26, 2001.[1] With its ten-letter abbreviation (USA PATRIOT) expanded, the Act's full title is "Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001".[2] The abbreviation, as well as the full title, have been attributed to Chris Cylke, a former staffer on the House Judiciary Committee.[3][4] For further information on the background of the legislation, see the history of the Patriot Act.
In response to the September 11 attacks and the 2001 anthrax attacks, Congress swiftly passed legislation to strengthen national security. On October 23, 2001, Republican Rep. Jim Sensenbrennerintroduced H.R. 3162 incorporating provisions from a previously-sponsored House bill and a Senate bill also introduced earlier in the month.[5] The next day, the Act passed the House by a vote of 357–66,[6] with Democrats comprising the overwhelming portion of dissent. The three Republicans voting "no" were Robert Ney of OhioButch Otter of Idaho, and Ron Paul of Texas. On October 25, the Act passed the Senate by a 98–1 vote, the only dissident being Russ Feingold of Wisconsin.[7]
Those opposing the law have criticized its authorization of indefinite detentions of immigrants; the permission given to law enforcement to search a home or business without the owner's or the occupant's consent or knowledge; the expanded use of National Security Letters, which allows the Federal Bureau of Investigation (FBI) to search telephone, e-mail, and financial records without a court order; and the expanded access of law enforcement agencies to business records, including library and financial records. Since its passage, several legal challenges have been brought against the act, and federal courts have ruled that a number of provisions are unconstitutional.
Many of the act's provisions were to sunset beginning December 31, 2005, approximately four years after its passage. In the months preceding the sunset date, anybody supporting the act pushed to make its sun-setting provisions permanent, while critics sought to revise various sections to enhance civil liberty protections. In July 2005, the U.S. Senate passed a reauthorization bill with substantial changes to several of the act's sections, while the House reauthorization bill kept most of the act's original language. The two bills were then reconciled in a conference committee criticized by Senators from both the Republican and Democratic parties for ignoring civil liberty concerns.[8]
The bill, which removed most of the changes from the Senate version, passed Congress on March 2, 2006, and was signed by President Bush on March 9 and 10 of that year.
On May 26, 2011, President Barack Obama signed the PATRIOT Sunsets Extension Act of 2011, a four-year extension of three key provisions in the Act:[9] roving wiretapssearches of business records, and conducting surveillance of "lone wolves"—individuals suspected of terrorist-related activities not linked to terrorist groups.[10]
Following a lack of Congressional approval, parts of the Patriot Act expired on June 1, 2015.[11] With passing the USA Freedom Act on June 2, 2015, the expired parts were restored and renewed through 2019.[12] However, Section 215 of the law was amended to stop the National Security Agency (NSA) from continuing its mass phone data collection program.[12] Instead, phone companies will retain the data and the NSA can obtain information about targeted individuals with permission from a federal court.[12]

The Real ID Act of 2005Pub.L. 109–13, 119 Stat. 302, enacted May 11, 2005, is an Act of Congress that modifies U.S. federal lawpertaining to securityauthentication, and issuance procedures standards for state driver's licenses and identity documents, as well as various immigration issues pertaining to terrorism.
The law sets forth requirements for state driver's licenses and ID cards to be accepted by the federal government for "official purposes", as defined by the Secretary of the United States Department of Homeland Security. The Secretary of Homeland Security has defined "official purposes" as boarding commercially operated airline flights, and entering federal buildings and nuclear power plants, although the law gives the Secretary the unlimited authority to require a "federal identification" for any other purposes.[4]
The Real ID Act implements the following:
  • Title II of the act establishes new federal standards for state-issued driver's licenses and non-driver identification cards.
  • Changing visa limits for temporary workers, nurses, and Australiancitizens.
  • Funding some reports and pilot projects related to border security.
  • Introducing rules covering "delivery bonds" (similar to bail, but for aliens who have been released pending hearings).
  • Updating and tightening the laws on application for asylum and deportation of aliens for terrorism.
  • Waiving laws that interfere with construction of physical barriers at the borders.
On December 20, 2013, the Department of Homeland Security announced that implementation of Phase 1 would begin on January 20, 2014, which followed a yearlong period of "deferred enforcement". There are four planned phases, three of which apply to areas that affect relatively few U.S. citizens—e.g., DHS headquarters, nuclear power plants, and restricted and semi-restricted federal facilities such as military bases.[5] On January 8, 2016, DHS issued an implementation schedule for Phase 4, stating that starting January 22, 2018 "passengers with a driver's license issued by a state that is still not compliant with the REAL ID Act (and has not been granted an extension) will need to show an alternative form of acceptable identification for domestic air travel to board their flight". Starting October 1, 2020 "every air traveler will need a REAL ID-compliant license, or another acceptable form of identification, for domestic air travel."[6] As of December 2018, 40 states and territories have been certified as compliant, and 16 have been granted extensions.[7]
